Ausar — Terms of Service

1. Acceptance of Terms

By accessing or using Ausar ("Service"), operated by Ausar ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree with any part of these Terms, please refrain from using the Service.

We reserve the right to update or modify these Terms at any time. Your continued use of the Service following any such changes will be considered your acceptance of the revised Terms.

2. About the Service

Ausar is an AI-powered platform that allows users to create images and videos using a variety of third-party AI models. The Service currently includes the following capabilities:

  • AI image generation (text-to-image, image-to-image)
  • AI video generation (text-to-video, image-to-video)
  • A personal gallery for storing and managing your generated content

3. Account Registration

Access to certain features of the Service requires you to register an account. By creating an account, you agree to:

  • Provide truthful and complete information during registration
  • Maintain the confidentiality of your login credentials
  • Accept full responsibility for all activity conducted under your account
  • Inform us promptly in the event of any unauthorized access or security breach

You must be at least 18 years of age to register an account and use the Service.

4. Credits and Payments

The Service operates on a credit-based system. Credits are required to generate content and are subject to the following conditions:

  • Purchasing credits: Credits may be acquired as one-time purchases or through subscription plans via our payment processor, Whop.
  • Credit usage: The number of credits consumed per generation depends on the type of content and the AI model selected, as shown within the Service at the time of generation.
  • Non-transferability: Credits are tied exclusively to your account and cannot be transferred to another user.
  • No expiration: Credits do not expire for as long as your account remains active.
  • Subscriptions: Subscription plans renew automatically at the end of each billing cycle unless canceled prior to the renewal date. Cancellation takes effect at the close of the current billing period.

All payments are handled securely through Whop, Inc. We do not store your payment card information. By completing a purchase, you also agree to Whop's terms and conditions.

5. User Content

Your inputs:You retain full ownership of any text prompts, images, or other materials you submit to the Service ("Input Content"). You are solely responsible for ensuring you hold the necessary rights to any Input Content you provide.

Generated output:Subject to these Terms and applicable law, you are permitted to use AI-generated content ("Output Content") for both personal and commercial purposes. By using the Service, you acknowledge that:

  • AI-generated content may not be eligible for copyright protection in all jurisdictions
  • Other users may produce similar or identical results from comparable prompts
  • We make no guarantees regarding the exclusivity of any generated content

License to us: By submitting Input Content, you grant us a non-exclusive, worldwide license to process and utilize that content solely for the purpose of delivering the Service to you — for example, transmitting it to third-party AI model providers to fulfill your generation request. We do not use your content to train our own AI models.

6. Prohibited Use

You agree that you will not use the Service to:

  • Generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or discriminatory in nature
  • Produce deepfakes or deceptive content intended to mislead or harm others
  • Create content that depicts minors in any inappropriate context
  • Upload or process images of real individuals without their explicit consent
  • Infringe upon the intellectual property rights of any third party
  • Attempt to reverse-engineer, decompile, or extract the underlying AI models
  • Bypass credit requirements, usage limits, or other technical restrictions of the Service
  • Use automated tools to scrape, crawl, or bulk-access the Service
  • Resell or redistribute access to the Service without prior written authorization
  • Use the Service to develop or assist in developing competing products or services

7. Third-Party AI Models

The Service integrates AI models provided by third-party providers. These models are made available "as is" and may be updated, modified, or discontinued by their respective providers at any time without prior notice. We have no control over the underlying models and cannot guarantee specific results, consistent availability, or uninterrupted performance.

8. Content Moderation

We reserve the right to review, remove, or restrict access to any content generated through or uploaded to the Service that we determine, at our sole discretion, to violate these Terms or applicable law. Accounts that repeatedly breach our policies may be suspended or permanently terminated.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no representations or warranties that:

  • The Service will operate without interruption, errors, or security vulnerabilities
  • Generated content will meet your specific requirements or expectations
  • Any technical issues or defects will be resolved within a particular timeframe
  • The results obtained through the Service will be accurate, reliable, or complete

10. Limitation of Liability

To the fullest extent permitted by applicable law, Ausar shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including, without limitation, loss of profits, loss of data, or loss of goodwill — arising from or in connection with your use of, or inability to use, the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of: (i) the total amount you paid to us in the three (3) months immediately preceding the claim, or (ii) one hundred US dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Ausar and its officers, directors, employees, and agents against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, any breach of these Terms, or any infringement of third-party rights.

12. Account Termination

We may suspend or terminate your account at any time, with or without prior notice, in circumstances including but not limited to:

  • Violation of these Terms
  • Use of the Service in a manner that poses a risk to other users or our operations
  • Requirements imposed by law or legal proceedings

You may choose to delete your account at any time. Upon termination, your right to access and use the Service ceases immediately. Any unused credits remaining in your account at the time of termination for cause will be forfeited.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Poland.
